NOTICE UNDER SECTION 38 OF THE ROAD TRAFFIC ACT 1994

Proposed Road Safety Improvement Works at Linden Avenue, Blackrock

Pursuant to the provisions of Section 38 of the Road Traffic Act 1994, Cork City Council hereby gives notice of its intention to carry out the following traffic management measures in the interest of the safety and convenience of road users at Linden Avenue, Blackrock.

It is proposed to carry out works to improve pedestrian facilities at the junctions of Linden Avenue N-S and Rosegreen Avenue with Linden Avenue W-E and Upper Beaumont Drive. Specifically, the works will include:

  • Reconstruction of existing footpaths on the approaches to the junctions, incorporating kerb-line build outs as per the Design Manual for Urban and Roads Streets,
  • Construction of 6 No. uncontrolled pedestrian crossings with dropped kerbs and tactile paving,
  • Installation of road markings and warning signage,
  • Minor alterations to the road drainage facilities, and
  • Improvement of the existing public lighting where necessary,
  • Other necessary associated ancilliary works.

In accordance with the Habitats Directive, an Appropriate Assessment (AA) Screening has been carried out on the proposed scheme, in relation to any potential impacts upon the Cork Harbour Special Protection Area [Site No. 004030] and the Great Island Channel Special Area of Conservation [Site No. 001058]. The findings of the AA screening noted that no significant effects on any Natura 2000 sites are likely and it was not necessary to undertake any further stage of the Appropriate Assessment process. In addition, the proposed scheme has been screened to determine whether an Environmental Impact Assessment (EIA) is required and it has been concluded that there will be no real likelihood of significant effects on the environment arising from the proposed scheme and that an EIA is not required.

Plans and particulars of the proposed scheme, including an Appropriate Assessment Screening Report and an Environmental Impact Assessment Screening Report, will be available for inspection from Friday 17th July 2020 until Monday 17th August 2020:

Submissions and observations with respect to the proposed scheme may be made;

  • electronically via Cork City Council’s Online Consultation Portal at https://consult.corkcity.ie. The documents are available to download at the right hand side of this web page under the "Materials" heading.
  • in writing to the Traffic Operations Division, Room 338, City Hall, Anglesea Street, Cork, T12 T997.

The deadline for receipt of submissions and observations is 4:00 pm on Tuesday 1st September 2020.

All comments, including names and addresses of those making submissions and observations, submitted to Cork City Council regarding this scheme, will form part of the statutorily required report to be presented at the monthly meeting of Cork City Council. Accordingly, they will be included in the minutes of that meeting and may appear in the public domain. Cork City Council will retain data for no longer than is necessary and in accordance with the Council’s Data Protection Policy and Privacy Statement (available to view on www.corkcity.ie) and relevant Data Protection legislation.
