Map No. 5 -Water Attenuation Tank - site and access to Public Infrastructure at the Entrance to Ard na Laoi should be Zoned as "ZO15"
The present tank is situated at the junction of the Ard Na Laoi estate and Middle Glanmire Road. The site forms part of the demise of No. 1 Ard Na Laoi. This subject site is highly elevated, sloping steeply from north to south and is covered by extensive vegetation. The site is enclosed by a large stone wall to the south, east and north and the driveway serving No. 1 Ard Na Laoi as well as The Gate Lodge, Ard Na Laoi to the west.
It is apparent that this holding tank was established in compliance with Condition No. 17 (c) of the parent permission for the Ard Na Laoi estate under Planning Application Reg. Ref. No. 14,818/89:
“17. The following drainage requirements shall apply: - (c) Surface water shall be disposed of to onsite holding tanks. Full detailed drawing of the proposed holding tanks to be submitted. The discharge control device to be used should be a hydrobrake type or similar. The recommended tank size to be 153 cu. mts. and 42 cu. mts respectively”.
Furthermore, in relation to Planning Application Reg. Ref. No. 18,165/93, a site layout drawing with the holding tank area clearly depicted was included by the applicant as part of correspondence with the Local Authority. There was also a condition attached to that grant of permission which stated that:
“A wayleave over sewers and storm tank area shall be provided. Full details shall be submitted to and agreed with the Planning Authority prior to the commencement of development”. As such, it has clearly been established from previous applications made that there is existing drainage infrastructure in the subject site which the applicant has not taken account of."
Notwithstanding the above, the Drainage Division report on the Cork City Council Planning Application Reg. Ref. No.
21/40284 states that “Cork City Council records indicate that there is an existing storm water holding tank occupying much of the southeast portion of the site. …the proposed development is situated directly on top of the tank”. Figure 1 Enclosed -includes an extract from the Drainage Division planning report highlighting the location of the existing holding tank on the subject site.
Accordingly access and area around this -Water Attenuation Tank should be zoned as"ZO15 Public Infrastructure and Utilities"
