Active Travel Improvement Works Tory Top Road, Ballyphehane
Notice Under Section 38 of the Road Traffic Act 1994
Pursuant to the provisions of Section 38 of the Road Traffic Act 1994, Cork City Council hereby gives notice of its intention to carry out the following traffic management measures in the interest of the safety and convenience of road users.
Tory Top Road, Ballyphehane
It is proposed to provide a new uphill raised cycle track on Tory Top Road, between its junction with Pearse Road and Lower Friars Walk.
The main elements of the proposed works are:
Provision of approximately 600m of single uphill raised cycle track on Tory Top Road.
Raised pedestrian and cycle crossings at junctions and accesses along the route.
Provison of uncontrolled pedestrian crossings.
Removal of existing roundabout at Tory Top Road / Connolly Road junction and replacement with new junction.
New road marking and signage.
Other necessary associated works.
In accordance with the Habitats Directive, an Appropriate Assessment (AA) Screening has been carried out for the project, in relation to any potential impacts upon the Cork Harbour Special Protection Area [Site No. 004030] and the Great Island Channel Special Area of Conservation [Site No. 001058]. The findings of the AA screening concluded that no significant effects on any Natura 2000 sites is likely and it was not necessary to undertake any further stage of the Appropriate Assessment process.
In addition, the proposed project has been screened to determine whether an Environmental Impact Assessment (EIA) is required and it has been concluded that the proposed development would not be likely to have significant effect on the environment and that the preparation and submission of an environmental impact report is not therefore required.

Any observations in relation to this proposal should be made electronically through https://consult.corkcity.ie/en/ or forwarded in an envelope marked “Active Travel Improvement Works Tory Top Road, Ballyphehane” to Senior Engineer, Infrastructure Development, City Hall, Anglesea Street, Cork. Final date for submissions is 5.00 p.m. on Friday the 5th August 2022.
All comments, including names and addresses of those making submissions and observations, submitted to Cork City Council in regard to this proposal, will form part of the statutorily required report to be presented at the monthly meeting of Cork City Council. Accordingly, they will be included in the minutes of that meeting and may appear in the public domain. Cork City Council will retain data for no longer than is necessary and in accordance with the Council’s Retention Policy and relevant Data Protection legislation.
