PLANNING AND DEVELOPMENT (SECTION 179A) REGULATIONS 2023
 

Pursuant to the provisions of the Planning and Development and Foreshore (Amendment) Act 2022 and in accordance with the requirements of the Planning and Development (Section 179A) Regulations 2023, Notice is hereby given that the development as described hereunder (“the proposed development”) is proposed to be carried out by Cork City Council.

The proposed development, named Estuary Way, is located at St Michael’s Drive, Mahon, Cork. The proposed development aims to deliver a pilot project for temporary residential housing and is comprised of 38 no. modular homes.  The development site area is approximately 1.01 hectares. The site is located at St Michael’s Drive, Mahon, Cork and is in the ownership of Cork City Council.

The proposed development will comprise 38 no. single storey semi-detached modular housing units, including:

  • 34 no. 2-bedroom units
  • 2 no. 2-bedroom accessible units
  • 2 no. communal/office space units

And all associated site development, landscape and boundary works as outlined in the plans and particulars for the development, including:

  • 12 no. car parking spaces
  • 2 no. disabled parking spaces
  • 2 no. set-down spaces
  • Communal and public open space
  • Relocation of the existing bus stop to allow for site entrance and
  • 1 no. ESB unit substation

In accordance with the Habitats Directive, an Appropriate Assessment (AA) Screening has been carried out on the proposed development, in relation to any potential impacts upon the Cork Harbour Special Protection Area [Site No. 004030] and the Great Island Channel Special Area of Conservation [Site No. 001058]. The findings of the AA screening noted that no significant effects on any Natura 2000 sites is likely and it was not necessary to undertake any further stage of the Appropriate Assessment process. It is not required to undergo an Appropriate Assessment (AA) under the Habitats Directive.

In addition, the proposed development has been screened to determine whether an Environmental Impact Assessment (EIA) is required and it has been concluded that there will be no real likelihood of significant effects on the environment arising from the proposed development and that an EIA is not required.

Plans and particulars of the proposed development, including an Appropriate Assessment Screening Report and an Environmental Impact Assessment Screening Report, will be available for inspection from 23rd August 2024 until 18th October 2024.

As per Article 81A a person may question the validity of any decision of the planning authority by way of an application for judicial review, under Order 84 of the Rules of the Superior Courts (S.I. No. 15 of 1986), in accordance with sections 50 and 50A of the Act.
