PLANNING AND DEVELOPMENT (SECTION 179A) REGULATIONS 2023
 

Pursuant to the provisions of the Planning and Development and Foreshore (Amendment) Act 2022 and in accordance with the requirements of the Planning and Development (Section 179A) Regulations 2023, Notice is hereby given that the development as described hereunder (“the proposed development”) is proposed to be carried out by Cork City Council.

The proposed mixed tenure residential development, scheme name to be confirmed, is located within serviced lands at Kilnap (townland), Old Mallow Road, Cork. The proposed mixed tenure residential development comprises of the construction of 95 no. housing units. The proposed mixed tenure residential development will provide a minimum of 87 homes for sale to the private market in the form of Affordable Housing. The site is located at Kilnap, Old Mallow Road, Cork, on lands in the ownership of Cork City Council. Vehicular access to the proposed development will be from the existing spine road on the serviced site which is accessible from the Old Mallow Road.

The proposed development will comprise 95 no. residential housing units, including:

  • 1 no. 4-bedroom two-storey detached house,
  • 72 no. 3-bedroom two-storey semi-detached houses,
  • 8 no. 3-bedroom two-storey town houses,
  • 6 no. 2-bedroom two-storey town houses,
  • 4 no. 3-bedroom apartments and 4 no. 1-bedroom apartments to be provided in 2 no. three-storey apartment/duplex buildings,
  • Ancillary site works including the provision of bicycle parking, bin storage facilities, surface car parking and landscaping,
  • Servicing proposals including the construction of a pumping station and the laying of underground sewers, mains and pipes.

In accordance with the Habitats Directive, an Appropriate Assessment (AA) Screening has been carried out on the proposed development, in relation to any potential impacts upon the Cork Harbour Special Protection Area [Site No. 004030] and the Great Island Channel Special Area of Conservation [Site No. 001058]. The findings of the AA screening noted that no significant effects on any Natura 2000 sites is likely, and it was not necessary to undertake any further stage of the Appropriate Assessment process. It is not required to undergo an Appropriate Assessment (AA) under the Habitats Directive.

In addition, the proposed development has been screened to determine whether an Environmental Impact Assessment (EIA) is required, and it has been concluded that there will be no real likelihood of significant effects on the environment arising from the proposed development and that an EIA is not required.

Plans and particulars of the proposed development, including an Appropriate Assessment Screening Report and an Environmental Impact Assessment Screening Report, will be available for inspection from 30th August 2024 until 25th October 2024.

As per Article 81A, a person may question the validity of any decision of the planning authority by way of an application for judicial review, under Order 84 of the Rules of the Superior Courts (S.I. No. 15 of 1986), in accordance with sections 50 and 50A of the Act.
